What a property lawyer actually does
A property lawyer is an advocate who specialises in land and real estate law. In Bangalore that covers a lot of ground: the Karnataka Land Reforms Act, the Karnataka Stamp Act, the Registration Act 1908, RERA, BBMP and BDA rules, and the local record systems that decide who is treated as the owner on paper.
The practical job is narrower than that list suggests. Before you pay, the lawyer answers one question: can this seller pass me clean, marketable title, and what could go wrong if they cannot? The answer comes as a written legal opinion that names the documents examined, the defects found and what to do about them.
Title and ownership chain
Whether the seller owns the property, how it came to them, and whether every earlier transfer holds up. We trace the chain back through a 30-year period and the mother deed.
Khata, tax and revenue records
A-Khata or B-Khata, e-Khata status, property tax receipts, and for land the RTC, mutation and survey records that show who the authorities treat as the owner.
Encumbrances and litigation
Loans, mortgages and charges on the Encumbrance Certificate, and any pending or past court cases that touch the property or its owners.
Approvals and compliance
Layout sanction, building plan, Occupancy Certificate, RERA registration for projects, and for converted land the DC conversion order.
Each of these is a separate service depending on what you are buying. See property document verification, full property due diligence, flat and apartment verification and plot and land verification.
When you need a property lawyer
The right moment is before any advance is paid or any sale agreement is signed. After that, a defect in the title is a dispute, not a reason to walk away. You should especially involve a lawyer when:
- You are buying a resale flat, a plot or a house and the seller wants a quick decision or a token advance.
- The property was inherited, gifted, partitioned or sold through a power of attorney, so the chain of ownership has unusual links.
- The land was recently converted from agricultural use, or sits in a layout whose approval you have not seen.
- You are buying an under-construction flat and need the builder's title, JDA, RERA registration and approvals checked.
- The khata is a B-Khata, an e-Khata is pending, or the records show a different name or extent from the deed.
- You are an NRI buying or selling remotely and cannot inspect the documents in person.
- A bank or the seller has handed you a legal report that you did not commission.
Our guides cover the common traps in more depth: the document verification checklist, common property document frauds in Bangalore and NRI property verification in Bangalore.
How the process works
- 1
Share your documents
Send the documents you have: sale deed or agreement, khata, tax receipts, Encumbrance Certificate, and the seller's identity and title papers. A photo or scan is enough to start.
- 2
Agree the scope and fee in writing
An advocate reviews what you have, tells you what is missing and what needs to be searched, and sends a written proposal with the scope, deliverables and timeline.
- 3
Records are checked
The title chain is traced back about 30 years. Revenue records, the Encumbrance Certificate, approvals and litigation are checked against what the documents claim.
- 4
You receive a written legal opinion
A report in plain language: what was examined, what the records show, any defects or risks, and the steps needed to cure them or reasons to reconsider. Typically 5-7 working days from a complete set of documents.
- 5
Drafting and registration, if you go ahead
If the title is clear, the same team can vet or draft the sale agreement and sale deed and assist with registration at the Sub-Registrar Office.
How property lawyer fees work
There is no single price for a property legal check, because the work varies a lot between a new apartment with a clean builder record and a plot that has changed hands six times. What moves the fee:
- The type of property: apartment, villa, plot, agricultural land or commercial.
- How many documents and transfers sit in its history, and how long the chain is.
- Whether a registry search, site inspection or visit to the revenue office is needed.
- Whether you also want agreement drafting, sale deed vetting or registration support.
- How urgent the timeline is.
Government charges such as stamp duty, registration fees and the cost of certified copies are separate and are paid to the authorities, not to the lawyer. We quote our professional fee in writing against a defined scope before any work starts. To get a quote for your property, use the proposal request.
Who does the work

Questions to ask any property lawyer before you hire
- What exactly will you examine, and which records will you check yourselves rather than rely on copies?
- Will I get a written report, and what will it say if the title is defective?
- How is the fee decided, and what is not included?
- How long will it take, and what do you need from me to keep to that?
- Who will be responsible for my matter, and how do I reach them?
Our longer guide on choosing a property lawyer in Bangalore goes through these in detail.
