    Home loan property legal check is the independent legal scrutiny of a property before a bank sanctions a loan or a buyer accepts it as mortgage security. Under the Transfer of Property Act 1882, only a person with a valid subsisting title can mortgage a property, and Section 58 makes a mortgage of a property without clear title voidable.     Verification happens in layers. I usually tell clients to think of it as peeling an onion - each layer either reassures you or warns you.

    1. Mother deed and chain of title: Trace ownership back at least 30 years, sometimes 40 for old Bangalore layouts. Every transfer must link cleanly to the next.
    2. Encumbrance certificate: Pull the EC from the Kaveri portal for the full period of ownership, not just the last 12 years. I've seen mortgages from 2004 sitting unreleased because nobody checked far enough back.
    3. Khata and tax receipts: Confirm the khata is in the seller's name and property tax is paid up. A khata transfer pending for years is a red flag.
    4. Approved plan and building licence: Check the BBMP or BDA approval, the sanctioned plan, and whether the actual construction matches it.

    • Fake or revoked power of attorney: The sale itself can be challenged, and you lose both the property and the money.
    • Unauthorised construction: BBMP demolition notices are real. No legal check means no warning.
    • Inheritance claims: Under the Hindu Succession Act 1956, daughters have equal coparcenary rights in ancestral property. If the family tree isn't verified, a legal heir can surface years later.

    The Supreme Court has repeatedly held that a buyer must act with reasonable diligence before purchase. In a 2023 ruling on bona fide purchaser claims, the Court made clear that a buyer who fails to inspect public records cannot later claim protection as an innocent purchaser. Skip the check, and the law treats you as the person who should have known.
