Need a Gift Deed Lawyer in Bangalore? Here Is What You Must Know Before You Sign

Gift deed lawyer Bangalore refers to an advocate in Bangalore who drafts, verifies and registers a gift deed, which is the legal document that transfers ownership of immovable property from one person to another without any sale consideration. According to the Registration Act 1908 (Section 17), a gift of immovable property must be registered, and under the Transfer of Property Act 1882 (Section 122), a gift is valid only when it is made voluntarily, without consideration, and accepted by the recipient while the donor is alive.

I am Advocate Raghavendra S C, and I have spent more than 20 years reading Bangalore property records, drafting deeds, and standing at sub-registrar counters across the city. In that time I have seen gift deeds save families from years of paperwork, and I have seen badly drafted ones destroy relationships and land people in civil court.

This guide is for you if a parent, sibling or relative wants to gift you a property in Bangalore, or if you are the one planning to gift. Read it fully before you sign anything.

What is a gift deed and why does it matter before you accept one?

A gift deed is a written document where the person giving the property (the donor) transfers it to the person receiving it (the donee) for no money. It is not the same as a will. A will takes effect only after death. A gift deed takes effect the moment it is registered and accepted.

That difference matters more than most people realise. Once you register a gift deed, the property is legally gone from the donor. You cannot quietly reverse it later because of a family argument. Under Section 126 of the Transfer of Property Act 1882, a gift can be revoked only in rare situations, usually where both parties agreed to a condition that has failed or where the gift was obtained by fraud or undue influence.

In 20 years, I have seen this go wrong dozens of times. A father gifts a site to one son, the other son objects, and the family lands in a Karnataka civil court for a decade. The deed itself was valid. The damage was done because nobody sat the family down and explained what registration actually means.

How is a gift deed different from a sale deed or a will?

A sale deed involves payment and a sale price. A gift deed shows zero consideration, though Karnataka stamp duty still applies at a concessional rate for close relatives. A will is a statement of intention that can be changed any time while the person is alive.

DocumentMoney exchangedTakes effectCan it be changed later?
Sale deedYes, full sale priceOn registrationNo, unless cancelled by court
Gift deedNo considerationOn registration and acceptanceOnly in narrow legal grounds under Section 126
WillNoAfter the person's deathYes, any time while alive

Takeaway: if you want the transfer to be final and immediate, it is a gift deed. If you want control until death, it is a will.

Who can legally gift property in Karnataka?

The donor must be the lawful owner, must be of sound mind, and must be alive and competent to sign. If the property is jointly owned, every joint owner must sign the gift deed. A gift by one co-owner of the entire property is void to the extent of the other owner's share.

The donee must be a living person on the date of the gift. An unborn child cannot be a donee. A company or trust can receive a gift, but the deed has to be drafted carefully to name the entity correctly.

One point I always raise with clients: if the donor is a Hindu woman holding property acquired before 2005, the Hindu Succession Act 1956 as amended in 2005 gives daughters equal coparcenary rights in ancestral property. A gift that tries to bypass a daughter's share in ancestral property is asking for a court case. I have seen exactly that happen in a family near Jayanagar, and the deed was eventually set aside.

What documents do you need before a gift deed is registered in Bangalore?

The sub-registrar will not accept a gift deed unless the paperwork is complete. Here is the checklist I hand my clients:

  • Original parent document or mother deed showing how the donor got the property
  • Latest encumbrance certificate (EC), the record that shows whether the property carries any loan, mortgage or legal due against it. In Bangalore, get the EC for at least 30 years if the property is old.
  • Khata certificate and khata extract from BBMP, BDA or the relevant local body
  • Latest property tax paid receipts
  • Possession certificate or proof of physical possession
  • PAN and Aadhaar of both donor and donee
  • Passport-size photographs and thumb impressions as required by the sub-registrar
  • Two witnesses with valid ID
  • If the property is an apartment, the sale deed of the flat, the undivided share deed, and society NOC where applicable
  • If the donor is senior or unwell, a medical certificate of sound mind is a smart safeguard

Missing even one of these can send you back home after a wasted trip to the sub-registrar. I have watched families do that three times in one week because nobody checked the khata status first.

How do you verify a property before gifting it in Bangalore?

Verification is not a formality. The donee inherits every defect the donor did not know about. So even if the gift is between family, check the property the way you would check a purchase.

Start with the EC. Then read the mother deed line by line. Then check the khata and the tax records. Then check whether the property falls under any acquisition notification or road-widening plan.

This is where property document verification in Bangalore becomes important. Most of the title opinions we return in two to three days come from exactly this kind of check, because a gift deed that transfers a defective title just passes the problem to the next generation.

Last year a client came to me ready to accept a gift of a site in Whitefield from his uncle. One EC search showed an unreleased bank mortgage the uncle had forgotten about. We had the mortgage cleared first, then registered the gift. Without that check, the son would have inherited a bank claim he knew nothing about.

How does gift deed registration work at a Bangalore sub-registrar office?

Karnataka has moved most of this online through the Kaveri portal, but you still need to attend in person for biometrics and signature. Here is the step-by-step path I walk clients through:

  1. Draft the gift deed with correct donor and donee details, property schedule, and the exact share being gifted.
  2. Work out stamp duty and registration fees based on the guidance value, not the market value.
  3. Pay stamp duty online through the Kaveri portal and generate the challan.
  4. Book an appointment slot at the jurisdictional sub-registrar office.
  5. Attend with both donor and donee, two witnesses, and all originals.
  6. Complete biometric capture and sign before the sub-registrar.
  7. Collect the registered deed once the process is complete, usually within a few days.
  8. Apply for khata mutation in the donee's name after registration.

Mutation is the step most people forget. Until the khata is transferred, the property records still show the old owner, and that causes problems when you later sell or apply for a loan.

How much does gift deed registration cost in Bangalore in 2026?

Karnataka charges stamp duty on a gift deed at a concessional rate when the donee is a close relative. As per the Karnataka Stamp Act schedule, gifts to specified relatives carry a much lower duty than a sale deed. A sale of property above Rs 45 lakh attracts 5% stamp duty plus 1% registration, whereas a gift deed to a close relative typically attracts a nominal stamp duty amount plus registration charges.

Always work off the guidance value published by the Karnataka government, not the price you would have got in the open market. The sub-registrar calculates duty on whichever is higher between the guidance value and the consideration shown, and for a gift the guidance value is what matters.

On top of the government charges, a gift deed lawyer in Bangalore charges professional fees. Our fees are flat and transparent, and they are typically a fraction of what large firms quote for the same drafting and scrutiny. No hidden add-ons.

Is a gift deed to a spouse or child cheaper than to a non-relative?

Yes. The concessional rate applies to specified close relatives, which usually includes spouse, children, parents, siblings and certain other blood relatives. A gift to a friend or an unrelated person attracts the standard stamp duty, and I always tell clients to check the exact category before they budget anything.

How long does a gift deed take in Bangalore?

If the documents are ready and the EC is clean, drafting takes two to three days and the sub-registrar appointment can usually be booked within a week. The whole process from start to registered deed can be finished in about ten to fifteen working days in most cases.

Where it slows down is when the mother deed is missing, the khata is in the name of a deceased person, or the property sits in a layout with unclear revenue records. Each of those can add weeks. If you are working against a deadline, tell your lawyer upfront so the urgent checks can be run first.

What happens if you skip the legal checks before a gift deed?

This is the part clients never want to hear, but I say it anyway. Skipping checks on a gift deed usually produces one of these outcomes:

  • A mortgage or loan surfaces later and the bank refuses to release the property without clearance
  • A family member files a partition suit claiming the ancestral share that should never have been gifted away
  • The khata stays in the old owner's name and the donee cannot sell or mortgage the property
  • The gift deed is drafted without acceptance language and is challenged as incomplete
  • A revenue acquisition notification applies to the land and the donee has no remedy

Each of these becomes a civil dispute, and Karnataka courts are already stretched. It is far cheaper to spend a modest fee on a proper check than to spend years in litigation.

Can a gift deed be cancelled after registration?

Only in narrow situations. If the gift was obtained by fraud, coercion or undue influence, a court can set it aside. If the deed itself contained a condition, such as the donee caring for the donor, and that condition failed, revocation may be possible. Plain regret is not a ground.

I always advise clients to think of a gift deed as a one-way door. Once you walk through it, you cannot simply turn back.

Why work with a gift deed lawyer in Bangalore instead of a template?

You can find gift deed formats online for free. What you cannot find online is a read of your specific property records, your family situation, and the local sub-registrar's expectations. A wrong schedule description, a missing acceptance clause, or a stale EC can void months of effort.

We at Legal Brigade handle exactly this work every week. We read the mother deed, run the EC, check the khata, draft the deed, and stand with you at the sub-registrar. If you want to understand the buying side better, our more property buying guides cover sale deeds, EC checks and khata transfers in detail.

If a gift is on your mind, book a free property consultation and bring the parent document along. One hour of scrutiny now can save you a decade of family disputes later.

Frequently Asked Questions

How much does property title verification cost in Bangalore?

For a standalone title verification of an apartment or a site, my office charges a flat fee between Rs. 15,000 and Rs. 25,000 plus GST. That covers a 30-year chain of title, encumbrance certificate check for 30 years, and a written opinion. If it is a large layout or a commercial property with multiple owners, the fee goes up to Rs. 40,000 or so. I have seen people pay Rs. 5,000 for a 'quick check' and later spend lakhs in litigation, so do not bargain on this.

How long does a property due-diligence check take?

In Bangalore, a proper due diligence on a resale flat or a BDA site takes 3 to 5 working days if the seller gives you clean copies of the mother deed, sale deed, khata, and tax receipts. If the title chain has gaps or the EC shows old transactions, it can stretch to 7 to 10 days. For urgent cases, I have turned around a basic title check in 48 hours, but that is only when the documents are complete and the sub-registrar records are online. Do not believe anyone who promises a thorough check in 24 hours.

Can I do property verification myself or do I need a lawyer?

You can pull an EC online and read the sale deed, but you will miss the traps. I have seen buyers who checked the EC and missed a registered family settlement deed from 1998 that created a share for a married daughter. Or they did not notice that the khata was in the name of a dead person. A lawyer checks the chain of title, verifies the seller's identity and capacity, and reads the fine print in the encumbrance certificate. For a gift deed, you also need to confirm the donor's ownership and that the property is not joint family property. That is not DIY work.

What is the stamp duty and registration fee for a gift deed in Bangalore?

In Karnataka, stamp duty on a gift deed is 5 percent of the market value of the property, and the registration fee is 1 percent, subject to a maximum of Rs. 1 lakh. If the gift is to a family member, some exemptions apply, but you must check the exact relationship. For example, a gift to a spouse or child may attract a lower rate, but a gift to a brother or a friend is treated differently. I always tell clients to budget around 6 percent of the market value, plus lawyer fees.

What documents does a gift deed lawyer in Bangalore need from me?

I ask for the original title deed of the donor, the mother deed, the latest khata certificate and extract, the encumbrance certificate for 30 years, property tax paid receipts, and the donor's and donee's PAN and Aadhaar. If the property is an apartment, I need the share certificate and the society NOC. For agricultural land, the RTC and mutation records are essential. Missing any of these will delay the deed, so gather them before you sit with a lawyer.

Can a gift deed be revoked after registration?

Once a gift deed is registered, it is generally irrevocable unless the deed itself contains a condition that the gift is revocable. I have seen donors try to cancel a gift to a son who later stopped taking care of them, but the law is clear: a completed gift cannot be taken back just because relations soured. The only exceptions are fraud, coercion, or a condition that the donee must maintain the donor. If you want to retain control, you should consider a will or a transfer with a life interest instead of an outright gift.

What is the difference between a gift deed and a sale deed for property transfer in Bangalore?

A gift deed transfers ownership without any monetary consideration, while a sale deed involves payment of a price. For a gift deed, stamp duty is 5 percent of the market value, and for a sale deed, it is also 5 percent, but the registration fee differs slightly. The bigger difference is in taxation: gifts to blood relatives are exempt from income tax under Section 56 of the Income Tax Act, but gifts to others may be taxable if the value exceeds Rs. 50,000. I always ask clients to get a tax opinion before choosing the route.

If you are about to sign a gift deed and there is money or family peace riding on it, do not rely on a template from the internet. At Legal Brigade, we check the title chain, the donor's capacity, and the stamp duty implications before you commit. We usually turn a full gift deed review around in 48 to 72 hours at a flat fee that we tell you upfront. Send us the documents and we will tell you exactly where you stand. book a free property consultation.

How to Verify a Gift Deed in Karnataka? A Lawyer’s Checklist

Gift deed verification is the process of checking whether a property transfer by gift is legally valid, free of hidden claims, and properly registered. According to the Transfer of Property Act 1882, a gift of immovable property must be made by a registered instrument signed by the donor and attested by at least two witnesses. In 20 years of practice, I’ve seen too many buyers lose money because they trusted a gift deed without proper due diligence.

Relinquishment vs Gift Deed: Which One Should You Use to Transfer Property in Bangalore?

Relinquishment vs gift deed is the question of whether a co-owner gives up their share in a joint family property or whether an owner voluntarily transfers property to another person as a gift. A relinquishment deed is stamped at 1,000 rupees in Karnataka while a gift deed to non-family members attracts full stamp duty, so choosing the wrong one can cost you lakhs or get your document rejected at the sub-registrar office.
